Green, but Not Always Clear: Navigating the NJ Cannabis Dispensary Landscape

But before you roll up and head to the nearest dispensary, it’s essential to understand the legalities of purchasing weed in our lovely state. Let’s dive into the Green Scene of NJ!
The Green Rush: A New Era Begins
New Jersey has joined the club of states that have legalized recreational cannabis use, making it possible for adults 21 and over to purchase weed from licensed dispensaries. This new policy took effect in early April 2021, bringing a wave of excitement across the state. But before you get too excited, remember: not every dispensary in NJ is equipped to sell recreational cannabis yet!
Dispensaries and Licenses
Currently, only six Alternative Treatment Centers (ATCs) in New Jersey have been approved to sell adult-use cannabis. These are the same facilities that have been providing medical marijuana since 2010. However, they’ve had to go through an extensive application process to get their Recreational Marijuana Conditional Licenses (RMCL). However, certain products, such as vape cartridges with flavors or higher than 50mg THC, are not allowed. Additionally, dispensaries cannot sell products that resemble candy, toys, or cartoon characters to prevent attracting children.
Staying within the Law
Now that you know where and what to buy, it’s important to understand the limits on cannabis purchases in NJ:
1. Purchasers are limited to one ounce of flower or its equivalent in edibles per transaction.
2. Only three ounces can be possessed at home, which is the equivalent of four ounces of flower.
3. It’s illegal to consume cannabis in public, and you cannot drive under the influence of cannabis.
4. Cannabis sales are subject to a 6.625% state sales tax, as well as the standard 7% sales tax on non-medical purchases. Medical marijuana is exempt from sales taxes.
The Road Ahead: Expansion and Equity
As New Jersey’s recreational cannabis program grows, we can expect more dispensaries to receive their RMCLs, expanding access to adult-use cannabis across the state. The New Jersey Cannabis Regulatory Commission (CRC) is also working on social equity programs to help communities disproportionately affected by the War on Drugs gain entry into the legal cannabis market.
